These general Terms and Conditions (“Terms”) apply to all sales, orders, and services provided by Spirit Marine Queensland Pty Ltd (“we”, “our”, “us”) in connection with the importation, sale, and delivery of boats and marine products in Queensland, Australia. The specific terms and conditions pertaining to a particular boat being sold by us will be set out in the contract signed by you ('Contract'). By purchasing or engaging our services, you agree to be bound by the Terms set out in these Terms and Conditions, and in your Contract.
2. Products and Services
We specialise in the importation and sale of new boats, related equipment, and accessories. All specifications, features, and prices are subject to change without notice. Images and descriptions on our website or promotional materials are provided as a guide only and may differ from the final delivered product.
3. Pricing and Payment
All prices are quoted in Australian Dollars (AUD) and include GST unless otherwise stated.A progress payment will be required at the time of order, with the balance payable by agreed progress payments prior to the handover of you new boat to you. Payment methods accepted include bank transfer, EFT, or other approved forms. Title and ownership of the vessel remain with us until full payment has been received and cleared.
4. Importation and Delivery
Estimated delivery dates are provided in good faith but may be affected by factors outside our control, including shipping delays, customs clearance, or manufacturer availability.We will keep you informed of progress and provide updates throughout the importation and delivery process. Any additional costs incurred due to changes in freight, duties, or taxes will be communicated and may be passed on to the buyer.
5. Warranty and After-Sales Support
All new boats are covered by the manufacturer’s warranty as outlined in the relevant documentation provided at the time of delivery.We will assist in coordinating warranty claims, service, and maintenance where applicable. Warranty coverage does not extend to normal wear and tear, misuse, or damage caused by neglect, improper operation, or unauthorised modifications.
6. Returns and Refunds
Refunds or exchanges are available in accordance with the Australian Consumer Law (ACL).We do not offer refunds for change of mind or cancellations once a boat has been ordered or imported, except where required by law. If a product is found to be defective or not as described, please contact us promptly so that we can assess and rectify the issue.
7. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential losses arising from the purchase, importation, or use of our products. Our total liability is limited to the replacement, repair, or refund of the affected goods, as determined under the ACL.
8. Customer Obligations
Customers are responsible for ensuring all vessel registration, insurance, and licensing requirements are met under Queensland law. You must provide accurate and complete information to facilitate importation, delivery, and compliance.
9. Privacy
We respect your privacy and handle all personal information in accordance with our Privacy Policy, which is available on our website or upon request.10. InconsistenciesTo the extent an inconsistency exists between these Terms and Conditions and your Contract, the terms set out in you Contract shall apply.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms will be subject to the jurisdiction of the courts of Queensland.
